Term of Charter:

The Charterer agrees to charter the Vessel from the time and dates listed on the booking platform 

The Charterer agrees to pay a total charter fee listed on the  ‘Get My Boat’ booking platform for the charter period. 
The Charterer agrees to provide a security deposit of $500 CAD on the booking platform before signing this Agreement. The security deposit shall be refunded to the Charterer. 
Insurance: The Owner agrees to maintain insurance coverage for the Vessel throughout the charter period, with coverage including but not limited to hull, machinery, and liability insurance.

The Charterer agrees to use the Vessel exclusively for recreational purposes and in a manner consistent with all applicable laws and regulations.

The Charterer shall not sub-charter or reassign the Vessel to any third party without the prior written consent of the Owner.

The Charterer shall not operate the Vessel while under the influence of alcohol or drugs.

The Charterer shall return the Vessel to the agreed-upon location in the same condition as received, except for ordinary wear and tear.

For the Charterer to captain the Vessel, they must prove competence and operational certifications to the Owner. Otherwise the Charterer is responsible to provide a certified captain for the Vessel for the duration of the charter. 

The Owner shall provide the Vessel in seaworthy condition and with all necessary equipment for safe operation and fuel for the boat and the sauna. 

The Charterer shall bear all costs associated with any additional expenses incurred during the charter period.

Both parties agree to indemnify and hold harmless the other party against any claims, damages, or liabilities arising out of the use or operation of the Vessel during the charter period.

This Agreement shall be governed by the laws of the Province of British Columbia, Canada.

If the Charterer requires the services of a captain to operate the Vessel during the charter period, the Charterer may hire a captain separately at their own expense. The Owner shall have no responsibility for providing a captain unless otherwise agreed upon in writing.

Captain's Qualifications:The Charterer agrees to ensure that any captain hired to operate the Vessel possesses the necessary qualifications, certifications, and experience required by law and is capable of safely operating the Vessel.

Responsibility for Captain:The Charterer shall be solely responsible for the actions, conduct, and performance of the hired captain during the charter period. The Owner shall not be liable for any acts or omissions of the hired captain.

Indemnification:The Charterer agrees to indemnify and hold harmless the Owner from and against any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities arising out of or relating to the actions or omissions of the hired captain during the charter period.

Insurance:The Charterer agrees to ensure that the hired captain is covered by appropriate insurance for the operation of the Vessel during the charter period.

Approval:The Owner reserves the right to approve the hiring of any captain and may require evidence of qualifications, certifications, and insurance coverage before granting approval.

The Charterer hereby releases, waives, discharges, and covenants not to sue the Owner, its officers, directors, employees, agents, and affiliates (collectively, the "Released Parties") from all liability to the Charterer, the Charterer's guests, invitees, or any other person for any and all loss or damage, and any claim or damages resulting therefrom, on account of injury to the person or property or resulting in death, whether caused by the negligence of the Released Parties or otherwise, while using, operating, or occupying the Vessel during the charter period. 

The Charterer acknowledges the inherent risk for themselves and their guest of using the sauna at high heat, and cold plunge/swimming in the open ocean. 

Do not use the sauna if pregnant or have a heart condition.

The Charterer further agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including attorney's fees, arising out of or relating to the use or operation of the Vessel during the charter period, including but not limited to claims for personal injury, property damage, or wrongful death.

This release and indemnification shall be binding upon the Charterer, the Charterer's heirs, successors, assigns, and legal representatives, and shall inure to the benefit of the Released Parties and their successors and assigns.
